The petitioner, Tufani Ram Bin, filed a writ petition under Article 226 of the Constitution of India before the Tripura High Court challenging an order dated 21.05.2022 passed by the Principal Secretary, Revenue Department, Tripura, in a condonation case arising out of a Second Appeal. The dispute concerned ownership and revenue record entries of certain land plots in West Tripura, where the petitioner claimed ownership and sought correction of revenue records, while private respondent No. 5 (Jishnu Debbarma) asserted that his mother had purchased the land from the petitioner's grandfather in the 1960s through registered sale deeds, and that the land was protected under Section 187 of the Tripura Land Revenue & Land Reforms Act, 1960. A series of revenue proceedings had taken place, including a restoration petition, a revenue case, a review petition, and appeals, with the petitioner contending that a key appellate order dated 20.07.2012 was passed without impleading him as a party and without affording him a hearing. The petitioner subsequently filed a Second Appeal with a condonation of delay application before the Secretary, Revenue Department, citing lack of knowledge of the order and the COVID-19 pandemic as reasons for the delay. The High Court, at the stage of hearing the matter finally on motion, noted that the petitioner had not produced any substantive title deed documents to establish ownership despite being given an opportunity to do so.
