The petitioner, Smt. Malabika Pal (Majumder), operated a BPCL petroleum retail outlet on NH-44 in Tripura on land she purchased in 2010, holding all requisite licences and permissions since 2015-16. NHIDCL issued an order dated 30.01.2026 revoking her NOC/authorisation with immediate effect, citing non-renewal of licence and unauthorised occupation of National Highway land acquired under the National Highways Act, 1956, without issuing any show-cause notice or affording a hearing. The Tripura High Court found that NHIDCL's order was passed in gross violation of principles of natural justice, that BPCL had in fact applied for renewal online on 19.06.2024 (a fact deliberately omitted by NHIDCL), and that a co-ordinate single judge had already set aside the related land acquisition memo dated 24.12.2025 as illegal for want of due process. The Division Bench further noted that the petitioner's right to object to land acquisition under Section 3A of the National Highways Act, 1956 is a substantive right, and the authorities had failed to meaningfully consider her objections before proceeding with acquisition.
