The Jubilee Hills Cooperative House Building Society filed five writ appeals before the Telangana High Court challenging a common interim order dated 02.04.2026 passed by a Single Judge, which had stayed the election process to the Society's Managing Committee scheduled for 05.04.2026. The dispute arose because approximately 887 members, including the respondents/writ petitioners, were excluded from the provisional voters' list on grounds of alleged disqualification and non-submission of KYC documents, while the inclusion of 271 newly admitted members was also challenged. The respondents contended that their exclusion was unlawful and that the Registrar/Commissioner had rejected their objections without proper hearing, whereas the appellant-Society argued that the Single Judge had made conclusive findings on disputed questions of fact and law without counter-affidavits or adequate opportunity to the Society to present its defence. The appellant further submitted that the Commissioner's jurisdiction under Rule 22(6)(d) of the 1964 Rules was limited and that the proper remedy for membership disputes lay before the Cooperative Tribunal under Section 76 of the Telangana Cooperative Societies Act, 1964. The Division Bench heard arguments from all parties and the judgment addresses whether the interim stay of elections was justified.
