The petitioner, Raju Pola @ Venkatesham Pola, filed three criminal petitions before the Telangana High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to quash three FIRs registered against him across different police stations in Vikarabad District for allegedly conspiring to manufacture and sell spurious DAP fertilizer packed in bags resembling those of reputed companies like Bharath DAP and IFFCO, thereby cheating innocent farmers. The petitioner contended that he was falsely implicated based solely on statements of other accused and that there were no specific allegations against him. The State opposed quashing, submitting that the petitioner actively facilitated the conspiracy, was a beneficiary of the illegal transactions, and that investigation was still in progress. Relying on the Supreme Court decisions in Bhajan Lal v. State of Haryana and Neeharika Infrastructure (P) Ltd v. State of Maharashtra, the High Court held that the FIRs prima facie disclosed cognizable offences and that this was not a case warranting exercise of the extraordinary power of quashing at the nascent stage of investigation. The Court also declined to grant a blanket 'no coercive steps' order, holding that such protection is in the nature of anticipatory bail and must be sought through the appropriate remedy.
