The petitioners (accused Nos. 1 and 2) filed a criminal petition before the Telangana High Court seeking to quash Crime No. 116 of 2026 registered by the Central Crime Station, Hyderabad, for offences under Sections 316(2), 318(4), 336(3), and 251(2) of the Bharatiya Nyaya Sanhita, 2023. The complaint, filed by respondent No. 2, alleged that the petitioners borrowed substantial amounts totalling approximately Rs. 1,88,80,000/- (including interest) and dishonestly created forged and fabricated receipts purporting to show repayment of Rs. 1,17,00,000/- which was never actually made. The petitioners argued the dispute was purely civil in nature and that a civil suit (O.S. No. 269 of 2025) was already pending, while respondent No. 2 and the State contended that specific allegations of dishonest intention, inducement, and forgery of documents attracted cognizable criminal offences. The High Court, upon analysis, found that the complaint and FIR contained specific allegations of forgery, fabrication of documents, and dishonest inducement that prima facie disclosed cognizable offences. Accordingly, the court declined to quash the proceedings, holding that the criminal case could proceed alongside the pending civil suit.
