The petitioner, Harsh Gajre, filed a criminal petition before the Telangana High Court seeking to quash FIR No. 549 of 2026 registered at Rajendranagar Police Station, Hyderabad, for alleged rape and kidnapping offences under the IPC and POCSO Act. The complainant alleged that on 14.11.2017, when she was a minor student, the petitioner forcibly had physical relations with her without her consent, and that he and his associates subsequently blackmailed her by threatening to upload her personal photographs on social media, causing her prolonged trauma and depression. The petitioner argued, among other things, that the complaint was filed after an unexplained delay of over nine years and was motivated by family animosity. The court held that delay in reporting sexual offences is not uncommon given trauma, stigma, and social pressures, and that the FIR prima facie disclosed cognizable offences warranting investigation. Accordingly, the court declined to quash the proceedings, finding no ground to interfere at the stage of investigation.
