This Family Court Appeal arose from a marriage solemnised on 08.10.2009 between the appellant-wife and the respondent-husband, who were also blessed with a female child. The respondent-husband had filed a petition under Section 13(1)(i) & (ia) of the Hindu Marriage Act, 1955 before the XV Additional District Judge-cum-II Additional Family Judge, Ranga Reddy District, seeking divorce on grounds of adultery and cruelty, alleging that the wife had an extra-marital affair with one Mr. Surya Prakash and subjected him to cruelty. The appellant-wife denied all allegations of adultery and counter-alleged dowry harassment, physical abuse, and false suspicion of her character by the husband and his family. The Family Court allowed the petition and granted a decree of divorce on the ground of cruelty only (not adultery), which the appellant-wife challenged before the Telangana High Court. The High Court's judgment, authored by Justice K. Lakshman, examined the oral and documentary evidence on record, including admissions made by the husband in cross-examination that he filed no police complaint about the alleged adultery and produced no proof of catching the wife red-handed.
