The accused was already a convicted habitual offender under the NDPS Act and had allegedly re-offended while on bail from Tihar Jail. The Supreme Court found the impugned bail order deeply problematic, noting the accused's prior conviction, his role as a syndicate organiser, and the serious concerns around the non-existence of valid sureties for foreign national accused persons. The Court undertook a comprehensive examination of bail principles under special statutes including the NDPS Act, PMLA, and UAPA, and issued broader directions regarding the grant of bail to foreign nationals and the surety system.
