This Civil Appeal before the Supreme Court of India arose from a TDSAT order concerning a dispute between M/s Polimer Cable Network (a Multi-System Operator) and several Local Cable Operators (LCOs) in Salem, Tamil Nadu, over the abrupt disconnection of cable television signals. TRAI had issued directions under Section 13 read with Section 11(1)(b) of the TRAI Act directing restoration of signals, and subsequently issued a Show Cause Notice proposing to file a complaint under Section 34 of the TRAI Act for non-compliance. The MSO challenged both the direction and the Show Cause Notice before TDSAT, arguing that TRAI lacked adjudicatory jurisdiction over disputes between service providers, which had been exclusively vested in TDSAT by the 2000 Amendment to the TRAI Act. TDSAT allowed the MSO's appeal, holding that TRAI had no jurisdiction to adjudicate the dispute, that any breach of interconnection regulations incorporated into contracts constituted a civil breach triable only by TDSAT, and that the direction and Show Cause Notice were void ab initio.
