The appellants, the wife and three children of Shaik Janimiya (a private security personnel killed in a motor accident on 23.06.2012 when a car struck him while he was walking in Malkajgiri), challenged the Telangana High Court's judgment which had enhanced compensation from Rs. 8,44,000/- to Rs. 11,00,672/- with interest at 7.5% per annum. Before the Supreme Court, the appellants argued that the High Court erred in affirming the deceased's monthly income at Rs. 7,000/- instead of the claimed Rs. 9,000/-, and that compensation under the head of 'parental consortium' for the children was not awarded in accordance with law. The Supreme Court, while noting that notice was issued limited to the question of parental consortium, exercised its discretion to also examine the income assessment, and proceeded to extensively discuss the legal framework governing consortium (spousal, parental, and filial) under the Motor Vehicles Act, 1988, citing multiple precedents including Pranay Sethi, Magma General Insurance, and Rajesh v. Rajbir Singh.
