This case concerns a family dispute over partition and separate possession of ancestral property belonging to the family of Mukkera Muthaiah (died 1979), situated in what is now Telangana. The plaintiffs (grandsons and their mother) filed a civil suit in 1998 claiming joint family property rights, which the Trial Court dismissed on grounds of limitation and a prior partition having already taken place during the lifetimes of the ancestors. The First Appellate Court reversed this, holding the properties to be joint family properties and the trial court's findings on partition to be erroneous. The High Court of Telangana then set aside the First Appellate Court's decree, relying on the Supreme Court judgment in Nagarjuna Gramin Bank v. Medi Narayana, holding that Civil Courts lacked jurisdiction over disputes relating to properties in scheduled areas from 1972 onwards.
