The appellant Lata, wife of the deceased Chandrakant Thakkar, challenged the concurrent dismissal of her compensation claim by the Railway Claims Tribunal, Bhopal and the High Court of Madhya Pradesh. Her husband had fallen from a running train (Train No. 12834 Ahmedabad-Howrah Mail) on 28 November 2015 and died instantly, but his ticket was lost along with his luggage. Both the Tribunal and the High Court denied compensation on the ground that the deceased's status as a bona fide passenger could not be established, also noting inconsistencies in the dates stated by the appellant. The Supreme Court, granting leave, examined Sections 123, 124, and 124A of the Railways Act, 1989, emphasising that Section 124A creates a 'no-fault' liability and is a beneficial provision requiring liberal and purposive interpretation in favour of claimants.
