The petitioners (Alisher Khan and others) challenged an order of the Board of Revenue, Rajasthan, which had set aside an order of the Revenue Appellate Authority, Nagaur, and granted a status quo over disputed ancestral Khatedari land (Khasra Nos. 679 and 688 at Mandabasni, Didwana). The Revenue Appellate Authority had declined to pass an immediate interim stay order, holding that it was inappropriate to do so without hearing all parties and examining the lower court's record. The respondent (Batul Bano) then filed a revision before the Board of Revenue, which allowed it and granted status quo. The Rajasthan High Court examined whether a revision under Sections 230 and 221 of the Rajasthan Tenancy Act, 1955, was maintainable against such an interlocutory order, in light of Section 230-A of the same Act, which creates an absolute statutory bar against revisions challenging interim orders passed in any proceeding under the Act. The Court held that the plain language of Section 230-A admits no ambiguity and that the Board of Revenue could not assume revisional jurisdiction contrary to this express legislative prohibition.
