The petitioners (defendants in the original revenue suit) challenged, via Article 227 of the Constitution of India, orders of the Sub-Divisional Officer (SDO) and the Board of Revenue for Rajasthan that rejected their application under Order VII Rule 11 CPC seeking rejection of the plaint. The original suit, filed in 2012 by the respondent-plaintiff, sought a declaration of khatedari (tenancy) rights, correction of revenue records, and a permanent injunction over agricultural land in Village Shrikishanpura, Tehsil Sanganer, Jaipur, which the plaintiff alleged had been wrongly recorded in the defendants' names during settlement operations. The petitioners argued that the suit was barred by law due to non-joinder of necessary parties (co-tenants) and because the disputed land had already been acquired by the State under the Land Acquisition Act, 1894 (notification u/s 4 in 1997, declaration u/s 6 in 1998, and award in 2000), making a declaration of khatedari rights impermissible under Section 16(vi) of the Rajasthan Tenancy Act, 1955. The SDO and the Board of Revenue both held that the acquisition did not cover the entire suit land and that the questions raised required framing of issues and appreciation of evidence, and accordingly dismissed the rejection application. The High Court was called upon to decide whether the impugned orders dismissing the Order VII Rule 11 CPC application were legally sustainable.
