The petitioners (defendants in the original suit) challenged orders passed by the Sub-Divisional Officer and the Board of Revenue for Rajasthan, which had rejected their application under Order VII Rule 11 CPC seeking rejection of the plaint. The original suit, filed in 2012 by the respondent-plaintiff, sought a declaration of khatedari (tenancy) rights, correction of revenue records, and a permanent injunction over agricultural land in Village Shrikishanpura, Tehsil Sanganer, Jaipur, which the plaintiff alleged had been wrongly recorded in the defendants' names during settlement operations. The defendants argued the suit was barred due to non-joinder of necessary parties (co-tenants) and because the disputed land had already been acquired by the State under the Land Acquisition Act, 1894 (notification under Section 4 in 1997, declaration under Section 6 in 1998, and award in 2000). The SDO and the Board of Revenue both held that acquisition of land does not automatically extinguish tenancy rights and that the issues raised required framing of issues and evidence, and accordingly dismissed the application for rejection of the plaint. The Rajasthan High Court (Jaipur Bench) heard the writ petitions under Article 227 of the Constitution challenging these concurrent orders.
