The petitioner Sahdav alias Sahdev Singh filed a criminal revision petition before the Punjab and Haryana High Court challenging the dismissal of his discharge application by the Special Judge, Faridkot in a case under the NDPS Act, 1985. He was implicated solely on the basis of a co-accused's disclosure statement, with no direct recovery from him, and raised a plea of alibi supported by photographs, hotel registers, and toll receipts showing he was in Rajasthan when the alleged offence occurred in Jharkhand. The petitioner also contended that mandatory provisions of the NDPS Act were not complied with, his arrest was illegal, and there was a discrepancy in the arrest memo date. The High Court, relying on settled Supreme Court precedents, held that at the stage of discharge, only a prima facie case needs to be established, the defence of the accused and documents produced by him cannot be considered, and the plea of alibi is a matter to be decided at trial. The Court found no sufficient ground to discharge the petitioner and upheld the trial court's order dismissing the discharge application.
