Sachin Gupta filed a petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 before the Punjab and Haryana High Court seeking regular bail in connection with FIR No. 48 dated 27.02.2026, registered for offences of cheating, criminal conspiracy, causing disappearance of evidence, and violation of the Punjab Travel Professional Regulation Act, 2014. The allegation was that the petitioner and co-accused cheated the complainant and his wife of Rs. 24,00,000 on the false promise of sending them abroad on a work permit. The State and the complainant opposed bail, citing serious allegations, the large amount involved, the petitioner's alleged status as a habitual offender, and risks of absconding and tampering with evidence. The Court, relying on Supreme Court precedents on the purpose of bail and personal liberty under Article 21, noted that the challan had been filed, no witnesses had been examined, charges were yet to be framed, and the trial would take long, making continued detention as an undertrial unwarranted. The petition was allowed and the petitioner was ordered to be released on regular bail subject to several conditions including not tampering with evidence, attending all trial dates, depositing his passport, and sharing his contact details with the investigating officer.
