Gurwinder Singh filed a second petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking regular bail in connection with FIR No. 200 dated 28.06.2025, registered at Police Station Phillaur, District Jalandhar, for offences under Sections 316(2), 318(4), 3(5), 61(2), and 351(3) of the Bharatiya Nyaya Sanhita. The petitioner had been in custody since 29.09.2025 (approximately 10 months and 28 days), the challan had already been presented, and none of the 16 cited prosecution witnesses had been examined. The Punjab and Haryana High Court noted that there was no tangible indication of the petitioner absconding or tampering with evidence, and that prolonged pre-trial incarceration without substantial trial progress weighed in favour of bail. Relying on Supreme Court precedents emphasising that bail is not punitive and that personal liberty under Article 21 must be protected, the Court allowed the petition and ordered the petitioner's release on regular bail subject to furnishing bail/surety bonds.
