The petitioner, Arun C. Ashar, a Director (Finance) of M/s United Phosphorus Limited, challenged a criminal complaint filed against him under Section 29 of the Insecticides Act, 1968, alleging that the company had manufactured a misbranded insecticide (Monocrotophos 36 SL) whose active ingredient was found below the required specification in two laboratory analyses. He sought quashing of the complaint and the summoning order before the Punjab and Haryana High Court under Section 482 of the Code of Criminal Procedure, 1973, primarily on grounds of limitation and lack of specific allegations against him personally. The Court held that the period of limitation commenced from the date the initial laboratory report was received (28.07.2010), and the subsequent re-analysis report could not extend or revive that period, making the complaint filed on 25.03.2014 time-barred. The Court further held that the summoning order was a non-speaking order that failed to reflect any application of judicial mind to the specific role of the petitioner, in violation of the principles laid down in M/s Pepsi Foods v. Special Judicial Magistrate. Accordingly, the petition was allowed and the complaint along with all subsequent proceedings, including the summoning order, were quashed.
