Dr. Himanshu Raj, a doctor residing in Lucknow, filed a petition before the Patna High Court seeking quashing of cognizance taken against him by the Chief Judicial Magistrate, Muzaffarpur, for offences including assault, cruelty, dowry demand, and causing miscarriage, arising from an FIR lodged by his wife, Dr. Akanksha. (2023) 15 SCC 488, the Court found that the documentary evidence of sterling quality directly contradicted the allegation of miscarriage caused by the assault, and that continuing the proceedings would amount to an abuse of process.
