Dharitree Enterprises, a handling and transporting contractor selected as the lowest bidder (L-1) in an e-tender floated by the Odisha State Warehousing Corporation (OSWC), challenged an Office Order dated 15.12.2025 by which OSWC terminated its contract for handling food grains at Kesinga warehouse and debarred it from participating in future OSWC tenders for three years. The grounds for termination and debarment were non-submission of the requisite Security Deposit (5% of contract value in the form of a Demand Draft and Bank Guarantee) within the stipulated 15 working days (i.e., by 09.12.2025), as required under Clause 8 of the Model Tender Form. The petitioner contended that the delay was caused by a genuine medical emergency affecting the Managing Partner and his son, that a representation seeking extension had been submitted on 07.12.2025, and that 50% of the security deposit was remitted via RTGS on 16.12.2025. OSWC denied receiving any prior representation and maintained that the debarment was lawful under Clause 8(iv) and Clause XI(f) of the Model Tender Form. The matter was heard by a Division Bench of the Orissa High Court comprising the Chief Justice and Justice Murahari Sri Raman, and was taken up for final disposal at the admission stage with the consent of both parties.
