The petitioner, Mohammed Abdul Wahab K, was appointed as a 'Vetti' (village servant) on 10.11.1975 in Kanyakumari District on a full-time temporary basis with a time scale of pay, and retired as a Village Administrative Officer on 30.09.2007. He sought reckoning of his entire service from 1975 for pensionary benefits, but the State rejected his representation relying on Rule 11(4) of the Tamil Nadu Pension Rules 1978 and G.O.Ms.No.625 dated 06.07.1995, which regularised part-time village assistants. The Madras High Court distinguished the petitioner's case from Full Bench and Division Bench rulings (Elangovan 2026 CTC 1; Balachandran 2021 MLJ 92) that denied 50% pre-regularisation service credit to part-time village assistants, noting those rulings addressed part-time appointees whereas the petitioner claimed full-time temporary status. However, the court found the writ petition was significantly delayed — filed approximately 14 years after retirement and 26 years after G.O.Ms.No.625 — and held that the delay and laches, along with the applicability of the Tamil Nadu Village Officers Service Rules 1980 and the inapplicability of the States Reorganisation Act 1956 argument, barred the claim.
