The Special Police Establishment Lokayukt challenged the trial court's acquittal of ASI Bharat Bairagi, who was accused of demanding and accepting a bribe of Rs. 20,000 from complainant Dalsingh Baghel in 2016, with a trap laid on 29.02.2016 resulting in recovery of tainted notes from under a register on the accused's table. The Madhya Pradesh High Court examined whether demand and acceptance of the bribe were proved beyond reasonable doubt, and whether electronic evidence without a Section 65B certificate was admissible. The court found that the demand was unproved as the transcript (Ex.P-7) lacked explicit demand words, the complainant was an interested witness, the electronic record was inadmissible for failing the Anvar P.V./Ram Singh thresholds, and the tainted notes were not recovered from the accused's personal possession. Finding no perversity in the trial court's reasoning and noting that two reasonable views were possible, the High Court declined to interfere with the acquittal.
