Two writ petitions were filed before the Madhya Pradesh High Court at Jabalpur by Rajendra Thakur @ Chhotu and Rajesh Thakur @ Bhaiya, challenging their preventive detention ordered by the District Magistrate, Jabalpur on 6 January 2026 under the National Security Act, 1980, subsequently extended twice for three months each. The petitioners argued that the detention order was based on incorrect and stale criminal case records, as the District Magistrate wrongly showed numerous cases as pending trial when the petitioners had in fact been acquitted in at least sixteen of those cases by competent courts. The court found clear non-application of mind on the face of the record, noting that the City Superintendent of Police, Additional Superintendent of Police, and Superintendent of Police all forwarded their reports on the very same day (6 January 2026) in near-identical language, and that the detention order incorrectly listed several already-decided cases as subjudice. The State defended the detention on the ground that the petitioner was involved in a bomb explosion on 4 January 2026 and that the Advisory Board had confirmed sufficient cause for detention, but the court's analysis focused on the factual inaccuracies and procedural infirmities in the detention order.
