Kumari Mithlesh Raipuriya, a 25-year-old Multi-Purpose Health Worker (ANM), was grievously injured in a motor accident on 1st May 2014 when an Indigo Car driven rashly by Amit Jain collided with the motorcycle she was travelling on, also killing her brother and a relative. The Sixth Motor Accident Claims Tribunal, Gwalior, awarded her Rs. 5,80,000/- with 6% interest, which she challenged before the Madhya Pradesh High Court under Section 173(1) of the Motor Vehicles Act, 1988, seeking enhancement on grounds of inadequate assessment of permanent disability (30% foot drop), loss of income, medical expenses, pain and suffering, and loss of marriage prospects. The Insurance Company contested enhancement, arguing the disability certificate was unreliable as no clinical tests were conducted, and that the claimant had rejoined her duties, indicating no functional loss of earning capacity. The High Court heard arguments from both sides and was in the process of examining the evidence on record, including documents relating to her employment, salary, and medical treatment, at the stage the judgment text concludes.
