Three petitions before the Kerala High Court challenged a common order dated 06.12.2023 of the Kerala Administrative Tribunal (KAT), which had dismissed original applications filed by candidates excluded from the eligibility list for Sub Inspector (Trainee) recruitment (Cat. 388-390/2019) notified by the Kerala Public Service Commission (KPSC) on 30.12.2019. The petitioners contended that the KPSC lacked authority to conduct a common preliminary examination for 42 distinct posts under Rule 2A (inserted on 11.08.2020, after the original notification), that physically unqualified candidates were permitted to appear, and that the eligibility list based on cut-off marks was invalid. The High Court, exercising supervisory jurisdiction under Article 227 of the Constitution of India, found that settled law permits shortlisting via preliminary examination when applications are unmanageably large, that the petitioners had participated in the examination without protest and challenged it only after failing, and that no concrete proof of prejudice was established. Finding no manifest error, perversity, or flagrant violation of law in the KAT order, and noting that the ranked list had already been published with appointments completed, the High Court declined to interfere with the Tribunal's order.
