Abdul Majid Peruvankuzhiyil, a retired Additional Director of Agriculture, sought retrospective promotion and revised pension with seniority fixed from 08.07.2017, the date a vacancy arose in the post of Additional Director, arguing that administrative delay by the State in convening the Departmental Promotion Committee (DPC) caused him to be promoted only on 19.04.2018, shortly before his retirement on 31.05.2018. The State of Kerala opposed the claim, contending that promotion to a selection post cannot be granted retrospectively from the date of vacancy, that no junior officer had superseded him, and that seniority can only run from the date of actual assumption of charge in the promoted post. The Kerala Administrative Tribunal (Additional Bench, Ernakulam) allowed the original application, set aside the State's rejection order (Annexure A13), and issued consequential directions in favour of the respondent-applicant. The State of Kerala then challenged the Tribunal's order before the Kerala High Court under Article 227 of the Constitution of India, invoking the Court's supervisory jurisdiction.
