The State of Kerala appealed against the acquittal of Junaid, a former Assistant Manager at Kerala Civil Supplies Corporation, Chalakudy Depot, who was tried for allegedly demanding and accepting Rs.4,000/- as illegal gratification from PW1 on 18.12.2008 in exchange for issuing cheques for commodities supplied by PW1. The Special Judge (Vigilance), Thrissur acquitted the accused, finding that the amount was paid as 'display charges' which were permitted by the district KCSC, and that PW1 had taken advantage of the situation to fabricate a trap case. The State challenged this verdict before the Kerala High Court, arguing that demand and acceptance of bribe were proved through oral evidence, the phenolphthalein test, recovery mahazar, and tape-recorded demand, and that the presumption under Section 20 of the Prevention of Corruption Act, 1988 ought to have been drawn. The defence contended that documents (Exts. D3–D6) established a legitimate practice of collecting display charges from FMCG suppliers, and that the amount was not a bribe. The judgment as reproduced is incomplete and does not record the final order of the High Court.
