The petitioner, Shamseer TKC, sought regular bail before the Kerala High Court after being arrested on 06.01.2026 and found in conscious possession of 709.52 grams of MDMA at a lodge in Kozhikode, facing charges under Sections 22(c) and 29 of the NDPS Act, 1985. His counsel argued that the grounds of arrest were not communicated to him as required under Article 22(1) of the Constitution and Section 47 of the BNSS, rendering the arrest illegal. The Court undertook a detailed review of binding Supreme Court precedents on the mandatory constitutional and statutory requirement to inform an arrestee of the grounds of arrest, including the requirement in NDPS cases to specify the quantity of contraband. However, on perusal of the case diary, the Court found that the grounds of arrest, including specific reasons, were duly communicated to the applicant and his relatives under Sections 47 and 48 of the BNSS. Accordingly, the bail application was dismissed.
