S. Jayaprasad, father of detenue Midhun @ Unni, challenged a preventive detention order issued by the District Magistrate under Section 3(1) of the Kerala Anti-Social Activities (Prevention) Act [KAA(P) Act] dated 12.05.2026, which was confirmed for six months under Section 10(4). The petitioner raised multiple grounds including unexplained delay between the last prejudicial activity and the detention order, non-communication of the right to make representations under Section 7(2) and Article 22(5), non-supply of relied-upon documents, and failure to consider bail cancellation as an alternative remedy. The Kerala High Court found that the delay was explained in the detention order itself, the right to represent was communicated, the document-supply plea was unpleaded and unsubstantiated, and that bail cancellation and preventive detention operate as independent remedies. The Court held that unlike cases where the detaining authority failed to consider bail conditions, in this case the detention order (Ext.P1) had specifically considered bail conditions and their violation, and the court could not interfere with the subjective satisfaction of the detaining authority where materials existed to support it.
