The wife of detenu Nandu Krishnan @ Unnikuttan filed a writ petition (habeas corpus) before the Kerala High Court challenging his preventive detention order dated 24 February 2026 issued under the Kerala Anti-Social Activities (Prevention) Act, 2007, classifying him as a 'Known Goonda'/'Drug Offender', and the subsequent confirmation order dated 22 April 2026. The petitioner alleged multiple procedural violations including non-compliance with Sections 7(1) and 7(2) of KAA(P)A, unexplained delays of 36 and 47 days at various stages, non-consideration of her representation before confirmation, failure to consider bail conditions, and non-application of mind by the detaining authority. She also raised a constitutional challenge arguing that KAA(P)A provisions on preventive detention of drug offenders are repugnant to the central PITNDPS Act, 1988 under Article 254 of the Constitution. The State contested all grounds, asserting procedural compliance, that the live link between prejudicial activity and detention remained intact, and that the detaining authority had duly considered the bail conditions and the detenu's history of resuming criminal activity after his earlier detention.
