The appellant (plaintiff), widow of late Dr. George C. Joseph, challenged the dismissal of her application for interim injunction in a suit for declaration, partition, and injunction concerning a 15-cent property in Edapally North Village, Ernakulam. She contended that her father purchased the property with his own funds, that the 1st respondent (her mother) held it only as a benamidar, and that a mortgage created by the 1st respondent in favour of Federal Bank (3rd respondent) in 2008 was unauthorised and void. The trial court (III Additional Sub Court, Ernakulam) rejected the injunction application, holding that the Civil Court's jurisdiction was barred under Section 34 of the SARFAESI Act, 2002, that the appellant had approached the court with unclean hands (since her father had executed a release deed in 1993 to defeat creditors), and that prima facie case and balance of convenience favoured the bank. The appellant appealed to the Kerala High Court, arguing that the Sub Judge had misapplied Section 34 of the SARFAESI Act and ignored binding Supreme Court precedents cited during arguments.
