This case arose from rent control proceedings (RCP 1/2022) before the Aluva Rent Control Court, where the landlords (legal heirs of Balan K.V.) sought eviction of the tenants (Asokan P.K. and Latha). After evidence was closed, the landlords filed applications (IAs 2/2026 and 3/2026) seeking appointment of a commission and permission to examine additional witnesses to rebut the tenants' evidence regarding the availability of alternate vacant premises. The Rent Control Court allowed these applications, and the tenants challenged this order before the Kerala High Court under Article 227 of the Constitution. The High Court found no jurisdictional error or illegality in the trial court's exercise of discretion to permit additional evidence, and dismissed the original petition, leaving both parties free to raise the question of the relevant date for determining availability of alternate premises at the appropriate stage.
