Dr. Vinuta B, a Senior Consultant in Obstetrics and Gynaecology at Cloudnine Hospital, Bengaluru, and the hospital's operating company filed a writ petition before the Karnataka High Court challenging eight notices issued by the Konanakunte Police Station in connection with an Unnatural Death Report (UDR) registered after a 29-year-old patient, Smt. Spoorthi Chithriki, died following a Hysteroscopic Polypectomy performed on 20 May 2026. The petitioners contended that despite fully cooperating with the investigation—providing medical records, CCTV footage, and an unedited 36-minute surgical video—the police continued to issue repeated notices, including three under Section 94 of the BNSS, 2023, demanding further documents, equipment, and the personal appearance of the doctor. The petitioners sought quashing of the notices and a direction to the police to observe the procedural safeguards for doctors laid down by the Supreme Court in Jacob Mathew v. State of Punjab (2005) 6 SCC 1. The High Court, during interim hearings, directed the hospital to place all treatment records and the post-mortem report on record, and the matter was reserved for final orders on 22 July 2026, with the judgment pronounced on 10 August 2026.
