The petitioner contended that the sexual relationship was consensual and amounted to 'friendship with benefits', relying on Supreme Court precedents that consensual acts cannot constitute rape. The complainant's counsel argued that the act occurred on the false promise of marriage and that the matter required a full trial. The High Court held that since the incident involved only one solitary instance and the question of consent was a matter of evidence, it could not conduct a mini-trial or enter into the merits of the allegations while exercising its jurisdiction under Section 482 Cr.P.C. Accordingly, the Court declined to quash the proceedings and held that the petitioner must face trial before the Sessions Court.
