The petitioner, Zubair Altaf Sheikh, through his wife, challenged a preventive detention order (No. DMS/PSA/40/2025 dated 12.09.2025) passed by the District Magistrate, Srinagar under the Jammu and Kashmir Public Safety Act, 1978, on grounds of non-application of mind, reliance on stale material (an FIR from 2022 whose earlier associated PSA detention had already been quashed by the High Court in 2024), vague grounds of detention, and non-supply of relied-upon documents (Beat Books/Patrol Books). The Jammu & Kashmir High Court found that the grounds of detention were insufficiently specific, lacking particular dates, places, persons, or concrete acts attributable to the detenue, and that the 2022 FIR had no live and proximate link to the 2025 detention order. The Court further noted that the detenue's employment as a Store Manager in Gurugram, NCR Delhi during the relevant period was an un-rebutted material circumstance not adequately considered by the detaining authority. Additionally, the failure to supply the Beat Books/Patrol Books dated 21.05.2025, 04.06.2025, and 04.08.2025 to the detenue was held to violate his constitutional right under Article 22(5) to make an effective representation against his detention.
