The petitioners (Judgment Debtors) challenged an order dated 5th August 2026 passed by the Senior Civil Judge, Hamirpur, in execution proceedings arising from a decree for specific performance of a lease agreement over agricultural land in Hamirpur, H.P. The decree, granted by the First Appellate Court on 30th October 2014 and having attained finality, directed the defendants to execute and register a lease deed in favour of the Decree Holder (M/s Competent Automobiles Co. Ltd.) within three months. The Judgment Debtors objected to execution on grounds including non-compliance with Section 118 of the H.P. Tenancy and Land Reforms Act (requiring permission for land transfer to a non-agriculturist), the proposed 99-year lease period exceeding the permissible 30-year limit under a State Government notification, and non-payment of rent arrears. The Executing Court dismissed these objections, allowed the Execution Application, and appointed a Local Commissioner to execute the lease deed, which order the Judgment Debtors have now challenged before the Himachal Pradesh High Court under Article 227 of the Constitution of India.
