Petitioner Sanjeev Kumar was arrested on 10 February 2026 after police recovered 31,800 Tramadol tablets and 3,735 Alprazolam tablets from his car, leading to FIR No. 26/2026 under Sections 22 and 29 of the NDPS Act. The key question was whether his failure to produce a valid licence during transit amounted to an offence under Section 21 of the NDPS Act, and whether he was entitled to regular bail on parity with co-accused who had already been granted bail. The court found, prima facie, that Section 21 NDPS Act was not made out, as the petitioner held a valid perpetual licence for the drugs in question and the Drugs Inspector clarified that non-production of the licence during transit violated Rule 62D of the Drugs and Cosmetics Rules, not the NDPS Act. Since the chargesheet had already been filed, custodial interrogation was no longer necessary, and the petitioner, a permanent resident of District Una, posed no flight risk. The court accordingly held the petitioner entitled to bail.
