The petitioner Ritik, aged 19 with no prior criminal record, sought regular bail after being arrested in connection with FIR No. 57/2026 (PS Palampur, Kangra) following a raid in which 16.06 grams of heroin was recovered from his house. The prosecution alleged he stored the heroin on the directions of one Abhishek Sahota, supported by financial transactions and deleted photographs found on co-accused Sumit's phone. The Himachal Pradesh High Court found that the quantity recovered was below the commercial threshold, that Section 37 of the NDPS Act's stringent bail conditions were therefore not applicable, and that no material directly linked the petitioner as a supplier. Considering his young age, absence of criminal antecedents, filing of the charge sheet, and the fact that custodial interrogation was no longer required, the Court held that bail could be granted subject to conditions to address any apprehension of re-offending.
