The petitioner Rajinder Kumar was convicted by the Trial Court for rash and negligent driving under Sections 279, 337, and 338 of the IPC after a vehicle he was driving fell into a gorge on 10.05.2007, injuring two passengers. The Trial Court sentenced him to simple imprisonment of one month and rigorous imprisonment of three months for the respective offences, with fines. The Additional Sessions Judge upheld the conviction and sentence on appeal, finding that the accused had negligently put the vehicle in neutral gear despite being warned, causing the accident.
