The petitioner, Prem Raj, challenged a preventive detention order dated 23.01.2026 passed under Section 3 of the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988 (PIT NDPS Act), based on his involvement in four drug-related FIRs spanning from 2012 to 2024. The petitioner argued that there was no live and proximate link between the last FIR (August 2024) and the detention order (January 2026), as over one and a half years had elapsed without any fresh incident. The court also found that a representation filed by the petitioner's wife on 04.03.2026, citing his serious medical conditions including diabetes, kidney issues, and hypertension, was not decided until 17.04.2026 without adequate explanation, violating the mandatory constitutional safeguards under Article 22(5) of the Constitution of India. Relying on the Supreme Court's decisions in Sama Aruna vs. State of Telangana (2018) 12 SCC 150 and Alfiya.A vs. State of Kerala (SLP (Crl.) No.8439 of 2026), the High Court held that the stale incidents and the unexplained delay in deciding the representation vitiated the detention order. Accordingly, the detention order and the rejection order were quashed and the petitioner was directed to be set free forthwith.
