Three petitioners — Gaurav Kumar, Deepak Kumar, and Saurav Kumar — sought pre-arrest bail before the Himachal Pradesh High Court in connection with FIR No. 64 of 2026 registered at Police Station Majra, District Sirmour, for offences under the Bharatiya Nyaya Sanhita (BNS), 2023, arising from a violent assault on one Shajid Ali. The prosecution alleged that the petitioners, armed with sticks and iron rods, beat Shajid Ali severely, causing multiple fractures and life-threatening pneumothorax, and threatened to kill him. The petitioners contended they were falsely implicated, that no corresponding injuries were found, and that since investigation was complete, custodial interrogation was unnecessary. The Court, applying Supreme Court precedents on anticipatory bail, held that pre-arrest bail is an extraordinary remedy to be exercised sparingly, and found a prima facie case for attempt to murder (Section 109(2) BNS) based on the nature of injuries and the threats uttered by the petitioners. Accordingly, the Court dismissed all three petitions.
