Dhani Ram @ Gallu, a 73-year-old man, sought regular bail before the Himachal Pradesh High Court under Section 483 of the Bharatiya Nagrik Suraksha Sanhita (BNSS) after being arrested on 18.09.2025 for alleged possession of 1.622 kg of charas and 1.624 kg of opium (commercial quantities) under Sections 18 and 20 of the NDPS Act. His earlier bail application before the Special Judge-III, Solan had been dismissed on the ground that the rigours of Section 37 of the NDPS Act were attracted due to recovery of commercial quantity of contraband. The petitioner argued for bail on grounds of his advanced age (73 years), the Revised Standard Operating Procedure (SOP) for Under Trial Review Committees (UTRCs) framed by the National Legal Services Authority pursuant to the Supreme Court's directions in WP(C) 406/2013 (In Re: Inhuman Conditions in 1382 Prisons), and inordinate delay in trial. The Court was not persuaded by the false implication argument or the delay ground, but found that the petitioner's age of 73 years brought him within the purview of the UTRC SOP, which provides for consideration of bail for persons above 70 years even in NDPS cases, and accordingly proceeded to consider his prayer for bail on that basis.
