Bal Krishan, who had been in custody since 02.06.2025, filed a bail petition under Section 483 of the Bharatiya Nagrik Suraksha Sanhita before the Himachal Pradesh High Court in connection with FIR No. 0052 of 2023, registered under Sections 21 and 29 of the NDPS Act. The case against him rested solely on a disclosure statement made by co-accused persons, from whose conscious possession 7.45 grams of heroin ('chitta') was recovered; no contraband was ever recovered from the petitioner himself. The State opposed bail citing five prior NDPS cases against the petitioner and the gravity of the offence. The Court relied on the Supreme Court's ruling in Tofan Singh v. State of Tamil Nadu (2021) 4 SCC 1, holding that disclosure statements under Section 67 of the NDPS Act are inadmissible as confessional statements, and further invoked the right to speedy trial under Article 21 of the Constitution as affirmed in Javed Gulam Nabi Shaikh v. State of Maharashtra (2024) and Umarmia v. State of Gujarat (2017). Noting that the co-accused from whose possession the contraband was recovered had already been granted bail, the Court found no justification to keep the petitioner incarcerated indefinitely during trial.
