Amritpal Singh was arrested on 18 December 2025 near Tunnel No. 5, Bhawana, when 10 grams of heroin (confirmed as diacetylmorphine by SFSL) was recovered from a pink bag on his lap in a bus. He filed a bail petition before the Himachal Pradesh High Court under Section 21 of the NDPS Act, arguing that since the quantity was below the commercial threshold, the stringent conditions of Section 37 of the NDPS Act did not apply. The court rejected this argument, holding that a sub-commercial quantity does not entitle an accused to bail as a matter of right, particularly given the petitioner's two prior FIRs for similar NDPS offences, which demonstrated serious criminal antecedents. The court also rejected the speedy trial argument, as the petitioner failed to show that the delay in trial proceedings was attributable solely to the prosecution. Accordingly, the bail application was dismissed.
