The petitioner, Aarin Mahajan @ Aryan Mahajan, sought regular bail before the Himachal Pradesh High Court in connection with FIR No. 282/2025 registered under the NDPS Act and BNS, arising from the recovery of 20.65 grams of heroin, 14 mobile phones, cash of ₹2,33,377, QR codes, and drug paraphernalia from the co-accused's house where the petitioner was present. The court noted that the petitioner actively resisted the search, had a prior criminal antecedent in FIR No. 141/2022 involving 202 grams of charas, and that large sums had been transferred to the petitioner's or his mother's account, indicating involvement in drug trafficking. The petitioner's claim for parity with co-accused Swati (sister), who was granted bail by the Supreme Court, was rejected on the ground that her role and circumstances were materially different, as she had no criminal antecedents and was found locked in a room. The court held that criminal antecedents, active resistance to search, and the gravity of the drug menace disentitled the petitioner to bail, and that no undue prosecution delay had been established. The bail petition was accordingly dismissed.
