The applicant, Suhailuddin Mohammedabdul Moati Saiyed, accused No. 2 in an FIR registered at Godhara 'A' Division Police Station, District Panchmahals, sought regular bail before the Gujarat High Court. He was alleged to have worked as a Computer Operator in the Mamlatdar's office and tampered with ration cards by overwriting the names of original holders to fraudulently obtain rations from Fair Price Shops. The court noted that the chargesheet had already been filed, no recovery remained pending, none of the offences carried the death penalty or life imprisonment, the applicant had no prior criminal antecedents, and he had been in custody since 12 March 2026. Relying on the Supreme Court's bail jurisprudence in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, and the constitutional guarantee of personal liberty under Article 21, the court held that prolonged pre-trial detention would amount to pre-trial conviction. The Gujarat High Court accordingly allowed the bail application subject to conditions including a personal bond of Rs. 25,000, surrender of passport, not leaving Gujarat without permission, and monthly reporting to the police station.
