Sangitaben, wife of Pravinbhai Babubhai Patel, filed a successive regular bail application before the Gujarat High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with an FIR registered at Dugri Police Station, District Valsad, for offences under Sections 406, 467, 468, and 471 of the IPC/BNS. She was alleged to be in conscious possession of 2.190 kg of Ganja (an intermediate quantity), had been in custody since 11 July 2026, and had one similar past antecedent and six antecedents under the Prohibition Act. The Court noted that the chargesheet had been filed, nothing remained to be recovered, the rigours of Section 37 of the NDPS Act were not applicable, and that prolonged pre-trial detention amounts to pre-trial conviction, invoking the principle that 'bail is the rule and jail is the exception' and Article 21 of the Constitution. Relying on the Supreme Court decisions in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, the Court granted regular bail subject to stringent conditions including a personal bond of Rs. 25,000 with one surety, monthly police station attendance, passport surrender, and a six-month bar on entering District Valsad.
