The applicant, Ramjibhai @ Rambhai Jivrajbhai Vala, sought successive regular bail before the Gujarat High Court in connection with a 2021 FIR registered at 'A' Division Police Station, Junagadh, for offences including murder (Section 302 IPC) and related charges under the IPC, Gujarat Police Act, and the SC/ST (Prevention of Atrocities) Act. The applicant had been in custody since 8 June 2021, the chargesheet had been filed, and out of 157 prosecution witnesses only 25 had been examined, indicating a prolonged trial. The Court noted that co-accused persons with similar roles had already been granted bail by coordinate benches of the same Court, and relied on the principle that prolonged pre-trial incarceration violates the right to speedy trial under Article 21 of the Constitution. Applying the parity principle and the settled bail jurisprudence that 'bail is the rule and jail is the exception,' the Court allowed the bail application subject to conditions including a personal bond of Rs. 25,000, surrender of passport, restrictions on leaving Gujarat, and monthly reporting to the police station.
