Pravinbhai Nanabhai Baria filed a regular bail application before the Gujarat High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with an FIR registered at Damavav Police Station, Panchmahals, for offences under the Gujarat Prohibition Act and the Bharatiya Nyaya Sanhita, 2023. The applicant contended he was falsely implicated and that nothing remained to be recovered. The State opposed bail, citing the gravity of the offences and the applicant's involvement. Justice Hasmukh D. Suthar, considering that the substantial part of the investigation was over, the applicant had been in custody since 24 May 2026, the offences were triable by a JMFC Court and not punishable with life imprisonment or death, and applying the principle that 'bail is the rule and jail is the exception' as affirmed in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, granted regular bail. The applicant was ordered released on a personal bond of Rs. 25,000 with one surety of the like amount, subject to several conditions including monthly reporting to the police station, not leaving Gujarat without permission, and surrendering his passport.
